This document contains the Terms and Conditions governing the use of our website, the purchasing process, and our return and refund policy. By accessing or using our website and/or making a purchase in our store, you agree to the terms and conditions outlined below.
1. Acceptance of Terms
By using the website of Tatiana Marques Jewelry, registering an account, or making a purchase, you agree to these Terms and Conditions, including the Privacy Policy and any other binding policies or documents.
Legal Basis: Article 4 of Law No. 67/98 of October 26 (Personal Data Protection Law) and Articles 12 and 13 of Regulation (EU) No. 2016/679 (General Data Protection Regulation - GDPR).
2. Description of Products and Services
Tatiana Marques Jewelry offers a wide range of jewelry, including customized products. The products are described as accurately as possible, but images and descriptions may vary slightly due to updates in materials or production techniques.
Legal Basis: Article 4, No. 1 of the Portuguese Civil Code (Decree-Law No. 47344/66, of November 25), regarding good faith in contractual relationships.
3. Purchase Process
3.1. Registration and Account Creation
To make a purchase on our website, the customer must create an account and provide truthful, complete, and up-to-date information. The customer is responsible for maintaining the confidentiality of their account and password.
Legal Basis: Article 10 of Decree-Law No. 24/2014, which regulates consumer rights in distance contracts (Distance Selling Law).
3.2. Placing Orders
After adding products to the shopping cart, the customer may proceed to checkout by providing the necessary delivery and payment details.
Legal Basis: Article 10 of Decree-Law No. 24/2014, regarding the right to clear and transparent information.
3.3. Payment
Payment can be made using available methods on our website. Tatiana Marques Jewelry reserves the right to refuse or cancel an order if fraud is suspected or an error occurs in the payment process.
Legal Basis: Article 9 of the Portuguese Civil Code, which governs adhesion contracts, and Portuguese legislation on electronic fraud (Law No. 109/2009).
3.4. Payment, Retention, and Customization Policy
Our jewelry pieces are customized and made to order.
The gold and materials delivered for production remain in our possession until full payment is made.
In case of non-payment, we exercise the legal right of retention and suspend delivery of pending orders.
Returns are not accepted on customized pieces, in accordance with Portuguese law.
Legal measures will be taken to ensure contractual compliance.
4. Return and Refund Policy
4.1. Return Period
The customer has the right to return purchased products within 14 days after the date of purchase, as per Portuguese legislation, unless the product is customized.
Legal Basis: Article 10 of Decree-Law No. 24/2014, which regulates the right of free resolution for purchases made at a distance.
4.2. Exceptions
Returns or refunds are not allowed for customized products, according to Decree-Law No. 24/2014, Article 17, paragraph c), except in cases of manufacturing defects or personalization errors.
Legal Basis: Article 17 of Decree-Law No. 24/2014, which excludes the right of resolution of contracts for customized or made-to-order goods.
4.3. Refunds
Refunds will be processed after the returned product has been inspected, and will be made using the same payment method as the purchase. The refund processing time may vary, but the customer will be notified once the amount has been refunded.
Legal Basis: Article 13 of Decree-Law No. 24/2014, which defines refunds in case of returns.
4.4. Return Costs
Tatiana Marques Jewelry is not responsible for return costs. Even if the purchase was accompanied by free shipping, the customer must bear the return shipping costs.
Legal Basis: Article 12 of Decree-Law No. 24/2014, which stipulates that the consumer bears the return costs, except in certain cases.
5. Customized Products
5.1. Exclusions and Corrections
Customized products are not eligible for return or exchange, except in cases of manufacturing defects or personalization errors. Requests for changes to a custom order will be evaluated on a case-by-case basis and may incur additional costs.
Legal Basis: Article 17 of Decree-Law No. 24/2014, which excludes returns for customized products, except in cases of defects.
The Company reserves the right to make any necessary corrections to ensure customer satisfaction, if feasible, considering that resources have already been spent in the production of the custom piece. The changes will be assessed on a case-by-case basis and may involve additional costs depending on the complexity of the requested correction.
5.2. Material and Color Variations
Tatiana Marques Jewelry reserves the right to make slight variations in materials and colors based on availability, while maintaining the quality and design of the piece.
Legal Basis: Article 280 of the Portuguese Civil Code, which allows suppliers flexibility in adjusting certain product elements, provided no substantial changes occur.
6. Payment and Ownership of Customized Jewelry
6.1. Order Execution and Payment
Custom jewelry orders are made to measure, based on specifications and materials provided by the client (e.g., gold). Production begins after payment confirmation or as otherwise agreed.
6.2. Right of Retention
Under Article 754 of the Portuguese Civil Code, the service provider (goldsmith/jeweler) may exercise the right of retention over the ordered item(s) (jewelry or materials) until full payment is made. This means the customized jewelry will remain in our workshop’s possession while any debt remains outstanding.
6.3. Partial Delivery and Non-Payment
If part of the order has been delivered and full payment is not made, we reserve the right to suspend delivery of the remaining pieces or services, as provided by Article 428 of the Civil Code. The client is obligated to fulfill their contractual payment obligations for goods and services provided.
6.5. Customization and Right of Return
Since these are customized jewelry pieces made according to the client’s specifications, they are not subject to the right of withdrawal or return provided under Article 17(1)(c) of Law No. 24/96 (Consumer Protection Law). Therefore, once production has started, the order cannot be canceled or returned except by mutual agreement.
6.6. Legal Measures in Case of Non-Payment
In case of non-payment, we reserve the right to initiate legal proceedings for coercive debt collection, including retention of the jewelry and possible notification of authorities if abuse of trust or unlawful appropriation occurs, pursuant to Articles 205 and 209 of the Penal Code.
7. Warranty
7.1. Warranty Period
All our jewelry pieces come with a 2-year warranty starting from the original date of purchase (with proof of purchase).
Legal Basis: Article 5 of Decree-Law No. 67/2003, which defines the legal warranty for goods and services.
7.2. Warranty Exclusions
The warranty does not cover damages resulting from misuse of the products.
Legal Basis: Article 6 of Decree-Law No. 67/2003, which outlines the conditions under which a warranty may be excluded.
7.3. Warranty Claims
If you experience any issue with a product within the warranty period, please contact us with your invoice number and describe the reason for the repair.
Legal Basis: Article 12 of Decree-Law No. 67/2003, which establishes the procedures for warranty claims.
8. Certification
8.1. Product Certification
All items available on the website are legally certified by INCM – Imprensa Nacional – Casa da Moeda, S.A. The INCM guarantees the legal hallmark verification (precious metal content in parts per thousand) and applies contrast marks with the manufacturer’s responsibility or equivalent.
Legal Basis: Article 2 of Law No. 98/2015, which regulates the certification of precious metals.
8.2. Application of Contrast Marks
Contrast marks are mandatory only for silver pieces weighing over 2 grams and gold pieces weighing over 0.5 grams.
Legal Basis: Article 3 of Law No. 98/2015, which mandates the use of contrast marks for precious metals.
8.3. Checking Certification
If in doubt about the authenticity of the marks, you can verify them through the services of the Portuguese Assay Offices (Contrastarias).

9. Conformity Guarantee
All products supplied by Tatiana Marques Jewelry are in compliance with applicable law and are of quality consistent with the sales contract. If a product is defective, the customer may request a replacement or refund in accordance with legal provisions.
Legal Basis: Article 5 of Decree-Law No. 67/2003, which establishes the legal warranty of conformity for movable goods under the Civil Code.
10. Intellectual Property
All content on the website, including but not limited to designs, images, text, and trademarks, is the exclusive property of Tatiana Marques Jewelry and is protected by copyright and intellectual property laws. Unauthorized use of any content on the site is prohibited.
Legal Basis: Law No. 16/2003 of July 8, which governs copyright in Portugal, and the Industrial Property Code (Decree-Law No. 110/2018).
11. Limitation of Liability
Tatiana Marques Jewelry is not responsible for any indirect, incidental, or consequential damages arising from the use of our products or services. Our liability will be limited to the amount paid by the customer for the product in question.
Legal Basis: Article 483 of the Portuguese Civil Code, which addresses limitations of liability, excluding indirect and consequential damages.
12. Privacy Policy
Your privacy is important to us. The personal data provided during the purchasing process will be handled according to our Privacy Policy, which can be found on our website. All data will be used exclusively to process your order, in compliance with GDPR (General Data Protection Regulation).
Legal Basis: Regulation (EU) No. 2016/679 (GDPR), which governs personal data protection, and Law No. 67/98 of October 26, which establishes data protection in Portugal.

This contract will be governed by the laws of Portugal. Any disputes involving Tatiana Marques Jewelry will be resolved exclusively by the competent courts in Lisbon, Portugal.
Legal Basis: Articles 3 and 9 of the Portuguese Civil Code, which regulate jurisdiction and the application of local laws in commercial contracts.
15. General Provisions
15.1. Force Majeure
Tatiana Marques Jewelry will not be held liable for any failure or delay in fulfilling its obligations caused by events of force majeure, such as natural disasters, transportation failures, or any other event outside the company’s control.
Legal Basis: Article 798 of the Portuguese Civil Code, which defines force majeure and its effects on contractual obligations.
15.2. Amendments
We reserve the right to amend these Terms and Conditions at any time. Any changes will be published on this page, and the effective date will be updated accordingly.
