1. GENERAL TERMS
These Terms and Conditions govern the use of the Tatiana Marques Jewelry website, the purchase of jewelry, and the commissioning of services, repairs, alterations and bespoke jewelry projects from Tatiana Marques Jewelry.
By placing an order, commissioning a service, paying a Design Fee, approving a proposal or otherwise entering into a contract with Tatiana Marques Jewelry, you confirm that you have read, understood and accepted the Terms and Conditions applicable to your order or project.
Specific conditions relating to an individual project may also be set out in a Bespoke Design Agreement, Jewelry Proposal, Client Gold Intake and Custody Form, written confirmation or other documentation issued by Tatiana Marques Jewelry. Where applicable, these documents form part of the contractual relationship.
Nothing in these Terms and Conditions limits or excludes any mandatory rights granted to consumers under applicable law.
The version of these Terms and Conditions applicable to an order or project is the version in force at the time the relevant contract is concluded, unless otherwise required by law.
2. BUSINESS INFORMATION

Atelier visits are available by appointment only.
Jewelry, returns, client materials or other items should not be sent to the atelier or any business address without prior written confirmation from Tatiana Marques Jewelry.
Portuguese distance selling law requires clear precontractual identification of the professional and appropriate information concerning the goods or services, price, payment, delivery, withdrawal rights and other material contractual conditions.
3. DEFINITIONS USED BY TATIANA MARQUES JEWELRY
For clarity, the following terms have the meanings described below when used by Tatiana Marques Jewelry.
Handcrafted
A handcrafted piece is produced, finished or substantially worked by hand using traditional and contemporary jewelry techniques.
Handcrafted does not mean that only one example of the design will ever be produced.
A handcrafted design may be produced more than once and may form part of a recurring Tatiana Marques Jewelry collection or design family.
Made to Order
A made to order piece is produced after an order is placed rather than being held as finished stock.
The same design may be produced for more than one client.
Where an existing design is made to order, natural variations arising from materials, sizing or handcraftsmanship may occur.
Personalised
A personalised piece is an existing or selected design altered according to individual specifications, such as engraving, sizing, gemstone selection, metal choice or another agreed personal detail.
Bespoke
A bespoke piece is developed specifically for an individual client through a dedicated design process.
It may be created entirely from an original concept or may involve substantial individual development based on the client's story, requirements, materials, gemstones or intended meaning.
A bespoke project is individually commissioned but does not automatically transfer intellectual property rights in the underlying design to the client.
Bespoke does not necessarily mean that no related design language, technique, motif, proportion, structural solution or artistic element will ever appear in another Tatiana Marques Jewelry creation.
One of a Kind
A piece described by Tatiana Marques Jewelry as One of a Kind is intended as a singular finished creation in that specific design and material or gemstone configuration.
The term One of a Kind will only be used where Tatiana Marques Jewelry has expressly designated the piece as such.
A handcrafted, bespoke, personalised or made to order piece is not automatically One of a Kind.
Unless a design is expressly described as One of a Kind, Tatiana Marques Jewelry may create the design again, develop variations of it or revisit elements of its design language in future work.
A unique natural gemstone does not automatically make the underlying jewelry design One of a Kind.
Where a piece incorporates an individually unique gemstone, the exact combination of gemstone and finished piece may be unique while Tatiana Marques Jewelry retains the right to produce the underlying jewelry design again using another gemstone or variation.
Limited Edition or Limited Series
Where a piece is expressly described as a limited edition, limited series or numbered edition, the relevant product description will identify the applicable limitation.
Expressions such as limited availability, handcrafted in small quantities or similar descriptions do not constitute a promise of a fixed numerical edition unless a specific number is expressly stated.
4. ORDERS AND CONTRACT FORMATION
A request for information, consultation, availability, price indication or estimate does not by itself create a contract.
An order or project becomes binding when the applicable conditions have been accepted and any payment required to confirm the order or begin the relevant stage has been received.
Depending on the project or purchase, confirmation may include:
written approval of a proposal;
payment of a Design Fee;
payment of the full or agreed purchase price;
written acceptance by email, WhatsApp or another agreed written channel;
signature of a Bespoke Design Agreement or other project document;
or another clear form of acceptance communicated by Tatiana Marques Jewelry.
Where an electronic order creates an obligation to pay, the payment obligation will be made clear before the order is completed, as required by applicable consumer law.
Tatiana Marques Jewelry may decline a project before a contract is formed where the project is technically unsuitable, commercially unviable, inconsistent with the standards or positioning of the brand, requires an unauthorised replica, creates disproportionate technical or financial risk, or cannot reasonably be completed to the required standard.
5. BESPOKE JEWELRY
Bespoke jewelry is created specifically for an individual client and may involve original design, adaptation of an existing Tatiana Marques Jewelry design, gemstone sourcing, transformation of client owned materials, engraving, individual sizing or other personal specifications.
The bespoke process may include consultation, creative direction, concept development, sketches, rendered visualisations, gemstone and material selection, design refinements, final approval, proposal, production, hallmarking and delivery.
Each bespoke project is considered individually.
Final technical decisions remain subject to the professional judgment of Tatiana Marques Jewelry, including decisions concerning structural integrity, durability, setting methods, metal thickness, materials, proportions, finishing and manufacturing feasibility.
Tatiana Marques Jewelry may refuse a requested design detail or technical solution where it is reasonably considered unsafe, structurally inadequate, excessively fragile or inconsistent with professional jewelry standards.
Client approval does not require Tatiana Marques Jewelry to execute work that the jeweler reasonably considers technically irresponsible.
6. REPLICAS, THIRD PARTY DESIGNS AND REFERENCES
Tatiana Marques Jewelry does not create unauthorised replicas, copies or substantially identical reproductions of jewelry designs belonging to other designers, brands or rights holders.
Bespoke commissions are developed as original Tatiana Marques Jewelry creations.
Reference images supplied by clients may be used to communicate inspiration, proportions, general aesthetic direction, technical preferences or particular details. They do not authorise the reproduction of a third party design.
Where a client supplies an image of another piece of jewelry, Tatiana Marques Jewelry may develop an original interpretation inspired by appropriate elements, provided that the resulting design is sufficiently distinct and does not infringe applicable intellectual property rights.
Tatiana Marques Jewelry may refuse any request that, in its reasonable professional judgment, would require reproducing another designer's protected work too closely.
The client must disclose where any supplied logo, artwork, monogram, drawing or other creative material belongs to a third party or is subject to restrictions on use.
Tatiana Marques Jewelry may request evidence of permission before reproducing third party protected material.
7. DESIGN FEE
A Design Fee may be required before a bespoke design process begins.
The amount is communicated before the design process starts and may vary according to the complexity and scope of the project.
Unless otherwise agreed in writing, the Design Fee includes the development of the initial concept and up to two rounds of design refinements.
Additional revisions, repeated revisions, substantial changes in creative direction or a new creative brief may require an additional Design Fee.
Any additional Design Fee will be communicated and approved before further work is undertaken.
If the project proceeds to production, the Design Fee is credited in full toward the final jewelry price unless expressly stated otherwise in writing.
The Design Fee compensates creative and professional work already performed and is not automatically refundable merely because a client later decides not to proceed, subject always to mandatory consumer rights.
Where a Design Fee relates to a service contracted at a distance and the client asks for design work to begin during the statutory withdrawal period, the applicable consequences are those established by Portuguese consumer law. Where the consumer exercises a valid withdrawal right after expressly requesting early performance, a proportionate amount may be payable for services already performed. Where the service has been fully performed following the legally required express request and acknowledgement, the withdrawal right may cease in accordance with law.
8. CLIENT INSTRUCTIONS, APPROVALS AND PROJECT RECORDS
Clients are responsible for providing accurate information concerning the requested design, dimensions, sizing, engraving, dates, reference images, materials and other relevant specifications.
Important instructions given verbally may be required again in writing before they form part of the documented specification.
Where a photograph, drawing, reference, measurement or other information is materially relevant to the requested result, it should be supplied digitally or in writing before final approval.
A reference shown only during a meeting or conversation but not subsequently supplied or documented may not form part of the final project specification unless expressly confirmed in writing.
Tatiana Marques Jewelry may suspend design or production until required information, measurements, materials or approval are received.
Written approval of a design, gemstone, engraving, dimensions, proposal or other specification confirms the client's acceptance of that element of the project.
Changes requested after approval may affect price, materials and completion time and may require a revised proposal or additional Design Fee.
9. PROPOSALS AND VALIDITY
Bespoke Jewelry Proposals set out the agreed project direction, materials, gemstones, anticipated timeline, investment and payment conditions applicable at that stage.
Unless otherwise stated, proposals are valid for 15 days from the date of issue.
After the validity period has expired, Tatiana Marques Jewelry may revise the price to reflect changes in precious metal prices, gemstone availability or pricing, supplier costs, specialist services, production costs, shipping, taxes or material specifications.
An expired proposal does not oblige Tatiana Marques Jewelry to maintain the original price.
10. PRICES, VAT AND PAYMENT
Prices are shown in the currency indicated in the relevant proposal, invoice or website listing.
Prices include VAT where legally applicable unless clearly stated otherwise.
For international orders, customs duties, import taxes, local taxes or other charges imposed by the destination jurisdiction may be payable by the recipient unless expressly included in the quoted price.
The payment structure applicable to each project will be communicated before confirmation.
For bespoke jewelry, the final jewelry balance must be paid in full before handcrafting or production begins, unless Tatiana Marques Jewelry expressly agrees otherwise in writing.
Where instalment or payment plan options are available, production will only begin once the amount required before production has been fully received, unless otherwise expressly agreed.
A failure to complete payment may delay or suspend the project.
Tatiana Marques Jewelry is not required to release completed jewelry or completed services where an amount lawfully due in relation to that work remains unpaid, subject to applicable law.
Where legally permitted, Tatiana Marques Jewelry may retain possession of a client's item where amounts due specifically in connection with work carried out on that item remain unpaid.
Any such retention does not transfer ownership of the client's property to Tatiana Marques Jewelry.
11. PRODUCT DESCRIPTIONS, WEIGHTS AND DIMENSIONS
Tatiana Marques Jewelry aims to describe each piece as accurately as reasonably possible.
Because jewelry is handcrafted and precious materials are individually worked, minor variations may occur in final weight, dimensions, thickness, gemstone measurements, positioning and finishing.
Any weight stated before manufacture may be an estimated weight unless expressly identified as the measured final weight of the completed piece.
Where the same design is produced in different ring sizes, bracelet lengths or dimensions, the metal weight and proportions may vary.
Gemstone carat weights and dimensions may vary slightly where stones are individually selected, unless a specific individually identified or certified stone has been agreed.
A reasonable handcrafted variation that does not materially alter the agreed design or specification is not, by itself, a lack of conformity.
12. COLOUR, IMAGES AND VISUAL REPRESENTATION
Photographs, videos, sketches and rendered images are intended to represent a piece as accurately as reasonably possible.
Colour perception may vary according to lighting, photography, screen calibration and viewing conditions.
Precious metal alloys, natural gemstones and pearls may also show differences in colour, tone, transparency, lustre or appearance under different conditions.
Rendered images and sketches are design communication tools and are not photographic reproductions of a finished handmade piece.
A handcrafted finished object will not necessarily be microscopically identical to a digital render, illustration or reference photograph.
The finished piece must nevertheless correspond to the agreed material specifications, essential design characteristics and approved project direction.
13. HANDCRAFTED CHARACTER
Tatiana Marques Jewelry pieces are individually handcrafted.
Small variations in texture, engraving, shape, finish, line depth, spacing, gemstone positioning or other hand executed details may occur and form part of the individual character of the piece.
Hand engraving and hand texturing are inherently individual processes.
Such variations are not considered defects where they are consistent with the approved design, the nature of handcrafted production and the expected professional standard.
This provision does not excuse a material departure from the agreed specifications or workmanship falling below the legally required standard of conformity.
14. SIZING AND MEASUREMENTS
The client is responsible for providing or approving the requested ring size and other personal measurements unless measurements are taken directly by Tatiana Marques Jewelry.
Sizing systems and measuring methods may vary.
Ring fit can also be affected by width, profile, temperature, pregnancy, medication, weight changes, swelling and individual anatomy.
Where a ring is produced according to the size approved by the client but later requires resizing because the client's preferred fit has changed or the supplied measurement was incorrect, resizing may constitute an additional paid service.
This does not apply where the finished piece does not correspond to the size actually agreed.
Not every ring can safely be resized to every size.
Gemstone placement, engraving, continuous patterns, unusual alloys, construction methods or previous repairs may limit the extent to which resizing is technically possible.
15. MATERIALS AND GEMSTONES
Tatiana Marques Jewelry works with precious metals and gemstones selected according to the specifications of each piece.
The principal gold standard of the brand is 18k gold. Other gold finenesses may be used where appropriate and agreed.
Natural gemstones may contain inclusions, colour zoning, surface characteristics, growth features and other natural variations.
These characteristics are part of the individuality of natural materials and are not, by themselves, defects.
Where laboratory grown gemstones are used, their origin will be disclosed.
Gemstone dimensions, weights, colour and appearance may vary where stones are selected individually.
Gemstone availability is not guaranteed until sourcing has been confirmed.
16. GEMSTONE SOURCING AND CLIENT APPROVAL
Gemstones may be sourced specifically for an individual project.
Photographs and videos are used to assist selection, but gemstone colour and appearance may vary under different lighting and screen conditions.
Where a particular gemstone is individually presented and approved by the client, that approval forms part of the project specification.
Once a gemstone has been specifically sourced, reserved or purchased for an individual project following client approval, cancellation or replacement may involve supplier restrictions or additional costs, subject to mandatory consumer law.
Where laboratory documentation is available, any identifying report number should correspond to the gemstone supplied.
Tatiana Marques Jewelry may recommend an alternative gemstone where the originally intended stone becomes unavailable before purchase.
17. GEMSTONE TREATMENTS AND INFORMATION
Gemstone descriptions are based on information supplied by professional suppliers, independent gemological documentation where available and Tatiana Marques Jewelry's reasonable professional assessment.
Certain gemstones may be routinely treated within the jewelry industry.
Where a treatment is known and materially relevant to care, value or the agreed specification, it will be disclosed where required and reasonably available.
Tatiana Marques Jewelry cannot guarantee undisclosed treatments in client supplied gemstones or stones whose history is unknown.
18. PEARLS
Natural and cultured pearls are organic gem materials and may show natural variations in shape, surface, lustre and colour.
Their surfaces are comparatively delicate and may be affected by perfume, cosmetics, chemicals, perspiration, abrasion and inappropriate cleaning.
Small natural surface characteristics and variations are not, by themselves, defects.
Specific pearl care guidance will be provided through the Jewelry Care & Maintenance information.
19. CLIENT OWNED GOLD, JEWELRY AND GEMSTONES
Tatiana Marques Jewelry may accept client owned gold, jewelry or gemstones for selected projects.
Acceptance is subject to technical assessment.
By delivering jewelry, precious metal, gemstones or other materials to Tatiana Marques Jewelry, the client confirms that they own the materials or have lawful authority to deliver them for the agreed work.
Tatiana Marques Jewelry may reasonably rely on that declaration unless circumstances require further verification.
Whenever reasonably possible, client materials will be documented at reception through written description, photographs, visible hallmarks, condition notes and gross weight.
A receipt, intake description, photograph, visible hallmark or preliminary observation does not constitute an appraisal, valuation, authentication, gemological opinion, certification of provenance or legal verification of ownership.
Any weight recorded at reception is a gross weight and may include gemstones, solder, non precious components, findings or other materials.
A visible hallmark or description provided by a client does not constitute confirmation by Tatiana Marques Jewelry of the actual composition or fineness of the material.
Testing, dismantling, refining or technical intervention may reveal a composition different from that originally expected or described.
If a piece contains materials different from those declared or reasonably expected, Tatiana Marques Jewelry may suspend the work and contact the client.
Additional testing, refining, replacement material or a revised technical approach may require a revised price.
Tatiana Marques Jewelry may decline to work on materials that are unsuitable, unidentified, unsafe, incompatible with the intended process or outside the materials normally accepted by the atelier.
20. CLIENT GOLD, ALLOYING AND TECHNICAL LOSSES
Client gold may require refining, alloy adjustment or the addition of new precious metal or alloying material to achieve the required fineness, colour, structural properties or final weight.
Normal technical losses occur during goldsmithing processes.
These may arise through cutting, filing, polishing, soldering, melting, refining, rolling, finishing and other workshop operations.
Technical loss does not mean that every amount of material removed during a process remains practically recoverable as individually attributable client metal.
Material may be lost in microscopic polishing residue, contaminated filings, soldered areas, refining residues or other workshop processing losses.
Where material can reasonably be segregated and returned, Tatiana Marques Jewelry will do so where technically appropriate and agreed.
Where client metal is combined with additional alloy or undergoes refining, final technical accounting may differ from a simple comparison between gross weights.
Any client gold not used in the project will be returned, excluding normal and unavoidable technical losses.
Tatiana Marques Jewelry does not acquire ownership of unused client gold merely because it has been placed in its custody.
21. EXISTING GEMSTONES AND DISMANTLING
Removing gemstones from existing settings can involve technical risk.
The risk may be greater where stones are already damaged, worn, chipped, fractured, highly included, unidentified, treated, glued, incorrectly set or previously repaired.
The client must disclose any known damage, treatment, repair or relevant history before work begins.
Tatiana Marques Jewelry will use reasonable professional care when dismantling existing jewelry but cannot guarantee that an already compromised or inherently fragile stone will withstand removal or resetting.
Where a gemstone appears unsuitable for removal or reuse, Tatiana Marques Jewelry may recommend an alternative approach or decline to proceed.
Existing gemstones that are not used in the new piece will be returned unless otherwise agreed.
22. PROVENANCE, INHERITED JEWELRY AND SENTIMENTAL VALUE
Tatiana Marques Jewelry does not certify the historical provenance, authorship, age or previous ownership of externally supplied jewelry unless such a service has been expressly agreed and independently documented.
Statements made by a client concerning family history, provenance or previous ownership may be recorded as client supplied information but are not independently verified unless expressly stated.
The client should inform Tatiana Marques Jewelry where an item has exceptional sentimental, historical or family significance before work begins.
Such significance will be treated with appropriate care and sensitivity.
Sentimental or emotional value is distinct from objectively assessable material or market value.
Nothing in this section excludes liability that cannot legally be excluded.
23. CUSTODY OF CLIENT PROPERTY
Tatiana Marques Jewelry will exercise reasonable professional care while client property is in its custody.
Client property may be transferred to selected specialist workshops, laboratories, refiners, setters, engravers, cutters, laser welding providers, platers, hallmarking authorities or other specialist service providers where required by the agreed work.
Where appropriate to the value or nature of the item, insured transportation or other appropriate security measures may be used.
Any liability for loss or damage will be determined according to applicable law and the circumstances of the individual case.
24. REMOVED OR REPLACED COMPONENTS
Where a repair or alteration requires removal or replacement of components, the client should state in advance if they wish recoverable removed components to be returned.
Precious metal, gemstones and identifiable valuable components belonging to the client will normally be returned where reasonably possible unless they are reused, exchanged as part of an expressly agreed process or cannot reasonably be separated due to the technical operation.
Consumable materials, solder, plating, adhesives, microscopic residues and other technically unrecoverable materials are not treated as returnable components.
25. REPAIRS, ALTERATIONS AND EXTERNAL JEWELRY
Tatiana Marques Jewelry primarily provides maintenance for its own creations and may accept external jewelry for repair or alteration selectively.
Acceptance of an external piece does not constitute a guarantee that every existing material, solder joint, setting, gemstone, previous repair or structural element is suitable for further intervention.
Repairs and alterations can reveal hidden weaknesses that were not visible before work began.
Where additional work becomes necessary after inspection or during the technical process, the client will be informed before material additional costs are incurred whenever reasonably possible.
Tatiana Marques Jewelry may refuse or stop work where continued intervention would create an unacceptable risk to the piece.
26. REPAIR ESTIMATES AND ADDITIONAL WORK
A repair estimate may be based on the visible condition of the piece before dismantling or technical intervention.
Hidden damage, previous repairs, internal weakness, unsuitable solder, fragile settings, unidentified materials or other conditions may only become apparent after work begins.
Where these circumstances materially affect the required work or price, Tatiana Marques Jewelry will seek the client's approval before proceeding with material additional work.
Minor technical adjustments reasonably necessary to perform the agreed service safely and correctly may be carried out as part of the agreed service where they do not materially alter the design or price.
27. SPECIALIST EXTERNAL SERVICES
Tatiana Marques Jewelry may use selected specialist professionals or facilities where the project requires services such as laser welding, specialist engraving, gemstone cutting, refining, plating, laboratory analysis, hallmarking or other technical operations.
Use of a specialist service does not mean that the project ceases to be managed by Tatiana Marques Jewelry.
Where Tatiana Marques Jewelry contracts the specialist service as part of the client's order, its responsibility toward the client remains subject to applicable law.
28. JEWELRY SERVICES AND TECHNICAL TERMINOLOGY
The following descriptions clarify the nature of common services provided or arranged by Tatiana Marques Jewelry.
The exact method required depends on the materials, construction, gemstones, previous repairs, existing finishes and condition of each piece.
Cleaning
Cleaning is the removal of dirt, oils, residues and surface contamination using methods considered suitable for the materials and gemstones present.
Cleaning does not automatically include polishing, refinishing, oxidation, plating, rhodium plating, repair or restoration unless these services are specifically included in the agreed work.
Some gemstones, pearls, enamels, adhesives and finishes require specialised or limited cleaning methods.
Polishing
Polishing is a finishing process intended to restore or increase the shine of a metal surface and reduce superficial scratches and marks.
Polishing removes a very small amount of material.
Repeated or excessive polishing may gradually soften engraving, edges, texture or other fine details.
Deep scratches, dents or deformation may not be removable through ordinary polishing without altering the shape or character of the piece.
Refinishing
Refinishing involves restoring or recreating a surface finish such as high polish, matte, satin, brushed, textured or another agreed finish.
The result may vary slightly from an aged original finish because of previous wear, repairs or manufacturing methods.
Oxidation or Patination
Oxidation or patination is a deliberate surface treatment used to darken selected metals or areas of a piece.
It is a surface finish and may gradually change or wear with use, friction, cleaning or polishing.
Cleaning or polishing an oxidised piece may lighten or remove the oxidised finish unless preservation of that finish has been specifically requested and is technically possible.
Rhodium Plating
Rhodium plating is a surface treatment in which a thin layer of rhodium is applied to compatible jewelry, most commonly white gold, to create a brighter white appearance and particular surface finish.
Rhodium plating is not permanent.
Its longevity varies according to the piece, frequency of wear, friction, skin chemistry and exposure to chemicals.
White gold is an alloy in its own right and may naturally display a warmer, greyer or less intensely white tone than rhodium plated jewelry.
Unless expressly stated in the proposal or service description, the use of white gold does not automatically mean that rhodium plating is included.
Gold Plating
Gold plating is a surface treatment in which a layer of gold is applied over another compatible metal.
Gold plating is not permanent and will gradually wear according to use, friction, exposure and the nature of the underlying piece.
Colour and appearance may vary according to the gold alloy, plating thickness, base metal and condition of the jewelry.
Replating may be required periodically.
Rose or Red Gold Plating
Rose or red gold plating is a gold plating process intended to create a warmer pink, rose or red tone.
Like other plated finishes, it is a surface treatment and may gradually wear through normal use.
The final tone may vary according to the plating solution, underlying metal and technical characteristics of the piece.
Resizing
Ring resizing involves changing the circumference or internal dimensions of a ring.
Depending on construction, it may involve cutting, adding or removing metal, soldering, reshaping, refinishing and checking or adjusting gemstone settings.
Not every ring can safely be resized to every size.
Bracelet or Chain Length Adjustment
Length adjustment may involve adding or removing links, rings or other components.
Where new components are required, their metal, dimensions and appearance will be selected to correspond as closely as reasonably possible to the existing piece, but exact matches may not always be possible in older or externally manufactured jewelry.
Soldering
Soldering joins metal components through the controlled use of heat and an appropriate solder alloy.
Certain gemstones, finishes or constructions may make conventional soldering unsuitable.
Laser Welding
Laser welding is a precision joining technique that concentrates heat in a small area and may be appropriate where conventional soldering would expose gemstones, pearls or delicate components to excessive heat.

Stone setting involves securing a gemstone within a setting using a technique appropriate to the design, gemstone and structure of the piece.
Different setting styles provide different levels of protection and exposure.
Stone Tightening and Setting Inspection
Gemstone settings may be inspected for movement, wear or damage.
Where technically appropriate, stones may be tightened or settings repaired.
An inspection cannot guarantee that a stone will never subsequently become loose, particularly where the jewelry has existing wear or is exposed to impact or repeated use.
Prong or Setting Repair
Worn or damaged claws, bezels or other setting components may require rebuilding, reinforcement or replacement.
Where setting wear creates a risk of gemstone loss, Tatiana Marques Jewelry may recommend that the jewelry not be worn until repaired.
Engraving
Engraving may be performed by hand, machine, laser or another agreed method.
Hand engraving is inherently individual and may display slight variations characteristic of handmade work.
Engraving may soften through wear or repeated polishing over time.
Stone Removal and Resetting
Removing a gemstone from an existing setting may involve technical risk, particularly where the gemstone is damaged, treated, highly included, fragile or previously set under tension.
Restoration
Restoration aims to preserve, repair or return a piece as closely as reasonably possible to an agreed condition while respecting its structure and materials.
Restoration does not necessarily mean returning an old piece to an indistinguishable new condition.
The extent of possible restoration depends on the condition, construction, materials, previous alterations and available components.
Maintenance
Maintenance may include inspection, cleaning, polishing, checking settings, refinishing or other preventive work appropriate to the piece.
The services included in a particular maintenance appointment will be confirmed for the individual jewelry item.
29. ENGRAVING AND PERSONALISATION APPROVAL
The client is responsible for checking the spelling, dates, initials, symbols and wording submitted for engraving or other personalisation.
Tatiana Marques Jewelry may provide a written or visual confirmation before engraving.
Once instructions have been approved, corrections resulting from incorrect information supplied or approved by the client may require additional work and cost.
Tatiana Marques Jewelry may refuse engraving or personalisation that is unlawful, offensive or infringes third party rights.
30. PRODUCTION AND TIMELINES
Production timelines are estimates unless a specific deadline has been expressly accepted in writing as essential to the contract.
Timelines may be affected by design complexity, client approvals, gemstone sourcing, supplier availability, hallmarking, specialist external services, material availability, technical complications, shipping or circumstances beyond reasonable control.
Production begins only when all conditions required for production have been satisfied, including final design approval and full payment where applicable.
Urgent commissions are accepted only when expressly confirmed.
Acceptance of an urgent commission does not remove the client's responsibility to provide required approvals, measurements, reference materials or payments promptly.
31. BRIDAL AND EVENT DATES
Where jewelry is commissioned for a wedding, ceremony or other fixed event, the client must communicate the event date before confirming the project.
Tatiana Marques Jewelry will only treat an event date as a guaranteed contractual deadline where that deadline has been expressly accepted in writing.
Clients are responsible for providing approvals, measurements, reference materials and payments within the requested timeframe.
Delays attributable to missing client information or approvals may affect the ability to meet the intended event date.
Urgent bridal or event commissions will only be accepted where technically and operationally feasible.
32. CLIENT DELAYS AND DORMANT PROJECTS
Where a project cannot progress because the client has not provided approval, information, measurements, materials or another required response, the project may be placed on hold.
Production capacity and originally estimated timelines cannot be guaranteed after a prolonged client delay.
Where a project remains inactive for an extended period, Tatiana Marques Jewelry may require confirmation of current pricing, material availability and production scheduling before work resumes.
If a proposal has expired or the project is materially delayed by the client before relevant precious metal or gemstones have been purchased, pricing may require revision to reflect current material and supplier costs, where legally permitted and communicated before further commitment.
33. TECHNICAL MODIFICATIONS DURING DEVELOPMENT
Tatiana Marques Jewelry may recommend or require reasonable technical modifications where an approved visual concept cannot safely or responsibly be manufactured exactly as initially represented.
Any material change to appearance or an agreed specification will be communicated for approval before manufacture whenever reasonably possible.
Minor technical adjustments that do not materially change the agreed design may be made where necessary to achieve structural integrity, durability or professional finishing.
34. CHANGES, SUSPENSION AND CANCELLATION OF A PROJECT
A request to change, suspend or cancel a project does not automatically reverse work already performed, materials already ordered, gemstones already reserved, specialist services already commissioned or costs already incurred.
Where a project is already in progress, any request to suspend or cancel it will be assessed according to the stage reached, work performed, committed materials, third party costs and applicable law.
Where legally permitted, amounts may remain payable for work already performed, materials acquired specifically for the project, specialist services commissioned and other legally recoverable costs or losses.
A request to suspend a piece that is already undergoing a technical process may not always permit the piece to be left immediately in an intermediate state.
Where necessary to protect the jewelry or safely complete an irreversible technical stage, Tatiana Marques Jewelry may complete that stage before suspension.
Tatiana Marques Jewelry may suspend a project where required payment has not been received, required information or approval is missing, substantial changes require reassessment, continuing the work would create unacceptable technical risk or circumstances make it impossible to proceed professionally and safely.
Mandatory consumer rights remain unaffected.
35. RIGHT OF WITHDRAWAL
Consumers entering into eligible distance or off premises contracts may have a statutory right to withdraw within the period established by applicable law.
For many distance contracts in Portugal, that period is 14 days, although the precise period and starting point depend on the type of contract and circumstances.
The statutory right of withdrawal does not normally apply to goods made according to the consumer's specifications or clearly personalised goods, unless the parties agree otherwise. This may include bespoke jewelry, engraved jewelry, individually personalised jewelry and other pieces manufactured specifically to the consumer's specifications.
The personalised goods exception concerns withdrawal without cause. It does not remove the consumer's statutory rights if the goods lack conformity with the contract.
For eligible non personalised goods, the detailed procedure is set out in the separate Returns, Cancellations & Consumer Rights Policy.
Where the law requires provision of a statutory withdrawal form or specific precontractual information, Tatiana Marques Jewelry will make that information available as required.
36. LEGAL GUARANTEE AND LACK OF CONFORMITY
Consumer purchases are protected by mandatory legal conformity rights.
Portuguese Decree Law No. 84/2021 applies to consumer sales of movable goods and also, with the necessary adaptations, to goods supplied under contracts for work or other services.
For covered movable goods, the professional is responsible for a lack of conformity that becomes apparent within three years from delivery.
A lack of conformity appearing within the first two years is generally presumed to have existed at delivery, subject to the legal exceptions.
A lack of conformity may include circumstances where the jewelry does not correspond to the agreed description, type, quantity, quality, characteristics or other contractual specifications.
The existence of damage or a problem after delivery does not automatically mean that the jewelry lacked conformity at delivery. Cause, use, condition and relevant circumstances may need to be assessed.
Nothing in these Terms limits mandatory statutory rights, and clauses seeking to exclude or limit those rights are ineffective where prohibited by law.
37. REPORTING A PROBLEM AND INSPECTION
If a client believes that a piece presents a lack of conformity, the client should contact Tatiana Marques Jewelry as soon as reasonably possible after discovering the issue.
The client may be asked to provide photographs, video, a description of what occurred, the date the issue was first noticed, information about use or any incident affecting the piece and relevant documentation.
Tatiana Marques Jewelry may require inspection of the piece before reaching a technical conclusion.
For repair or replacement under the statutory conformity regime, the consumer must make the goods available to the professional, at the professional's expense as required by law.
The client should stop wearing or using a piece where continued use may aggravate the issue.
38. REPAIR, REPLACEMENT AND OTHER LEGAL REMEDIES
Where a legally recognised lack of conformity exists, the consumer is entitled to the remedies provided by applicable law.
These may include restoration of conformity through repair or replacement, proportionate price reduction or termination of the contract, subject to the statutory conditions governing each remedy.
Whenever legally permitted and technically appropriate, Tatiana Marques Jewelry will favour repair and preservation of the original piece.
Repair or replacement under the statutory conformity regime must be carried out free of charge, within a reasonable period and without serious inconvenience to the consumer.
Portuguese law provides that repair or replacement should not normally exceed 30 days unless the nature and complexity of the goods, seriousness of the lack of conformity and effort required justify a longer period.
Where a lack of conformity becomes apparent within 30 days after delivery, Portuguese consumer law provides a specific right of rejection under which the consumer may request immediate replacement or termination of the contract.
Any remedy will be determined according to the applicable law and the circumstances of the individual case.
39. NORMAL WEAR, ACCIDENTAL DAMAGE AND USE
Jewelry is subject to wear through normal use.
Depending on the piece, normal wear may include surface scratches, gradual loss of polish, gradual wear to engraving or texture, wear to plating or rhodium, and gradual wear to clasps, chains, prongs or moving components.
Damage resulting from impact, crushing, pulling, bending, inappropriate chemicals, inappropriate cleaning, improper storage, accidental damage, misuse or third party intervention is not automatically attributable to Tatiana Marques Jewelry.
Gemstones vary significantly in hardness, toughness, cleavage, porosity and sensitivity.
Some stones require substantially more care than others.
Detailed recommendations are provided on the separate Jewelry Care & Maintenance page and, where applicable, in the Certificate of Authenticity.
40. THIRD PARTY INTERVENTION
Repairs, resizing, polishing, setting, soldering, engraving, plating or other work carried out by another jeweler or third party may affect the structure, finish, gemstones and original workmanship of a piece.
Tatiana Marques Jewelry is not responsible for damage or alterations caused by unauthorised third party intervention.
Where a piece has been altered elsewhere, Tatiana Marques Jewelry may require inspection before accepting further work.
This does not limit statutory rights unrelated to the third party intervention.
41. AFTERCARE AND COMMERCIAL SERVICES
Any complimentary cleaning, inspection, adjustment or other aftercare service offered by Tatiana Marques Jewelry is a commercial service separate from the statutory legal guarantee.
The availability, duration or conditions of complimentary aftercare do not reduce mandatory consumer rights.
Services that fall outside statutory conformity obligations may be chargeable.
42. JEWELRY CARE PRODUCTS AND ACCESSORIES
Tatiana Marques Jewelry may provide or recommend a polishing cloth, cleaning product or other care accessory appropriate to a particular piece.
Care products must only be used in accordance with the instructions supplied and on materials for which they are suitable.
A product suitable for one piece may not be suitable for another, particularly where pearls, opals, porous gemstones, treated gemstones, oxidation, plating, enamel or other sensitive materials are present.

43. CERTIFICATION, HALLMARKING AND GEMOLOGICAL DOCUMENTATION
Jewelry is hallmarked where required by applicable Portuguese precious metals law.
Portuguese Assay Offices are official technical services integrated within the INCM and are responsible for testing and marking precious metal articles and applying official marks that attest the precious metal and legal fineness in accordance with the Portuguese legal regime.
Tatiana Marques Jewelry may also issue its own Certificate of Authenticity, documenting information such as piece reference, metal, gemstones, dimensions, weight, craftsmanship, completion date and other relevant specifications.
The Tatiana Marques Jewelry Certificate of Authenticity is a brand certificate and is distinct from an independent gemological laboratory report.
Depending on the gemstone, its characteristics, value, source and the requirements of the individual project, a gemstone may also be supplied with an independent gemological report or certificate issued by a recognised gemological laboratory.
Independent gemological documentation may be particularly appropriate for certain diamonds, coloured gemstones or other significant stones.
Depending on the type of report and laboratory, it may contain information concerning weight, dimensions, colour, clarity, cut, treatments, origin or other characteristics.
Not every gemstone or piece of jewelry is supplied with an independent gemological report.
Where a client specifically requires an independently certified gemstone, that requirement should be communicated and agreed before gemstone sourcing and purchase.
The availability and cost of independently documented gemstones may differ from comparable stones supplied without individual laboratory documentation.
An independent gemological report relates to the gemstone examined by the issuing laboratory and is subject to that laboratory's grading standards, terminology, scope and limitations.
Tatiana Marques Jewelry does not alter or independently guarantee the findings of a third party gemological laboratory but will accurately represent the documentation supplied with the gemstone.

44. INTELLECTUAL PROPERTY AND ORIGINAL DESIGNS
All original designs, sketches, drawings, renders, models, concepts, photographs, written materials, website content and other creative work produced by Tatiana Marques Jewelry remain protected by applicable intellectual property law.
Payment of a Design Fee or purchase of the finished jewelry does not, by itself, transfer intellectual property rights in the underlying design, sketches, drawings, renders, concepts or creative material.
The client acquires the physical jewelry purchased and any additional rights expressly granted in writing.
Designs, sketches or renders may not be copied, reproduced, manufactured by another party, commercially exploited or distributed for production without prior written authorisation.
The fact that a piece is bespoke does not prevent Tatiana Marques Jewelry from retaining its general artistic language, techniques, motifs or intellectual property rights.
45. PHOTOGRAPHY AND TECHNICAL RECORDS
Tatiana Marques Jewelry may photograph jewelry and materials during intake, design, production, inspection, repair and completion for technical, quality control, record keeping and evidentiary purposes.
Project records may include photographs, measurements, weights, written approvals, material descriptions, correspondence and service history.
Tatiana Marques Jewelry may photograph completed work as part of its creative archive.
Any public use of material containing personal data or information that directly identifies a client will be handled in accordance with applicable data protection law and the Privacy Policy.
Where confidentiality has been specifically agreed for a project, the agreed confidentiality conditions will be respected.
46. COMMUNICATION
Tatiana Marques Jewelry may communicate with clients through email, WhatsApp or another agreed written channel.
For accuracy and protection of both parties, important instructions, approvals, complaints, changes or agreements may be required in writing.
Where a dispute, misunderstanding or material disagreement arises, Tatiana Marques Jewelry may require further communication concerning the matter to remain in writing so that both parties have a clear record.
Clients are expected to communicate respectfully with Tatiana Marques Jewelry and its representatives.
Abusive, threatening or persistently disrespectful communication may result in communication being restricted to written channels and, where legally and operationally possible, suspension of non essential project activity.
This does not remove any mandatory consumer right or prevent a lawful complaint.
47. DELIVERY, COLLECTION AND TRANSFER OF RISK
Delivery options, restrictions and costs are communicated before the order is finalised where required by law.
Insured delivery may be available depending on destination and value.
Tracking information will be provided where available.
Where Tatiana Marques Jewelry arranges delivery to a consumer, risk of loss or damage remains with Tatiana Marques Jewelry until the consumer, or a third person indicated by the consumer other than the carrier, acquires physical possession, except where applicable law provides otherwise.
Clients are responsible for providing a complete and accurate delivery address.
Apparent transport damage should be photographed and reported promptly so that the appropriate carrier procedure can be initiated.
Personal collection is available only where agreed in advance.
48. UNCOLLECTED ITEMS
Where a client fails to collect or arrange delivery of a completed piece or other item after being notified that it is ready, Tatiana Marques Jewelry may continue to hold the item for a reasonable period.
Where prolonged non collection creates additional storage, insurance or administrative consequences, these will be handled in accordance with applicable law and any written notice provided to the client.
Tatiana Marques Jewelry does not acquire ownership of client owned gold, gemstones or jewelry merely because the client fails to collect them.
No client property will be disposed of except where legally permitted and following any legally required procedure.
49. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
Subject to applicable law, Tatiana Marques Jewelry is not responsible for losses arising solely from incorrect information supplied by the client, client approved specifications, undisclosed pre existing damage, inherent fragility or unknown treatment of client supplied gemstones, normal wear, misuse, accidental damage, inappropriate care, unauthorised third party intervention or circumstances beyond reasonable control.
Tatiana Marques Jewelry will not be responsible for indirect or consequential losses to the extent that such exclusion is permitted by applicable law.
50. FORCE MAJEURE AND EVENTS BEYOND REASONABLE CONTROL
Tatiana Marques Jewelry will not be responsible for delay caused by circumstances that could not reasonably have been prevented or controlled, including serious supplier disruption, transport interruption, public authority action, serious illness, natural events, infrastructure failure or comparable circumstances.
Where such an event affects a project, the client will be informed as soon as reasonably possible and an appropriate solution will be sought.
Mandatory legal rights relating to delay or non performance remain unaffected.
51. COMPLAINTS
Tatiana Marques Jewelry takes complaints seriously and aims to resolve genuine concerns fairly and professionally.
Complaints should preferably be submitted in writing to:

The complaint should contain sufficient information to identify the order or project and explain the issue.
Where a complaint concerns the physical condition or conformity of a piece, Tatiana Marques Jewelry may require the jewelry to be made available for inspection before a technical conclusion can be reached.
Use of the internal complaints process does not restrict mandatory legal remedies.
52. ALTERNATIVE DISPUTE RESOLUTION
Consumers may have access to Alternative Dispute Resolution mechanisms in accordance with Portuguese and European consumer law.
Portuguese Law No. 144/2015 establishes the national framework for consumer Alternative Dispute Resolution and applies to qualifying contractual disputes between consumers and providers of goods or services.
The relevant Alternative Dispute Resolution entity or entities applicable to Tatiana Marques Jewelry will be identified on the website before publication of this page.

53. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions and contracts entered into with Tatiana Marques Jewelry are governed by Portuguese law, without prejudice to mandatory consumer protection provisions that may apply to consumers resident in another jurisdiction.
Any dispute will be dealt with by the court, tribunal, consumer dispute resolution entity or other competent body determined under applicable law.
Nothing in these Terms requires a consumer to waive any mandatory right to bring proceedings before a legally competent forum.
54. PRIVACY AND PERSONAL DATA
Personal data is processed in accordance with applicable data protection law and the Tatiana Marques Jewelry Privacy Policy.
The Privacy Policy explains the categories of personal data processed, purposes, legal bases, retention, recipients, international transfers where applicable and the rights available to data subjects.
55. COOKIES
The use of cookies and similar technologies is governed by the Tatiana Marques Jewelry Cookie Policy and the consent choices made through the website's consent management system.
Cookies requiring consent will be used only in accordance with applicable law and the choices recorded through that system.
56. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent legally possible without affecting the validity of the remaining provisions.
Mandatory consumer law prevails wherever it conflicts with these Terms.
57. CHANGES TO THESE TERMS
Tatiana Marques Jewelry may update these Terms and Conditions to reflect changes in law, services, business practices or operational requirements.
Changes apply prospectively.
The terms applicable to a particular order or project remain those forming part of the contract when it was concluded, except where a later change must apply by law or is expressly agreed by the parties.
